1. Service and parties

FORGE Strength OS ve FORGE markalı hizmetler Fatih Colak / FORGE tarafından işletilir. Bu şartlarda "FORGE", "biz" veya "hizmet"; mobil uygulamayı, web sitesini, destek sayfalarını, topluluk alanlarını, bağlı cihaz/sağlık entegrasyonlarını ve abonelik özelliklerini kapsar. Sorular için destek merkezini veya mfatihcolak1@gmail.com adresini kullanabilirsin.

FORGE Strength OS and FORGE-branded services are operated by Fatih Colak / FORGE. In these terms, "FORGE," "we," or "the service" includes the mobile app, website, support pages, community areas, connected device/health integrations, and subscription features. For questions, use the support center or email mfatihcolak1@gmail.com.

2. Yaş, hesap ve güvenlik

2. Age, account, and security

• Hizmeti kullanmak için yerel hukuk daha yüksek yaş şartı getirmedikçe en az 16 yaşında olmalısın.
• Hesap bilgilerin doğru, güncel ve sana ait olmalıdır.
• Şifreni, cihazını ve giriş bilgilerini korumaktan sen sorumlusun.
• Hesabını izinsiz başkasına devredemez, satamaz veya kiralayamazsın.
• Güvenlik riski, kimlik ihlali, sahte hesap veya kötüye kullanım şüphesinde hesabı doğrulamanı isteyebilir, erişimi sınırlayabilir veya hesabı askıya alabiliriz.

• You must be at least 16 years old unless local law requires a higher age.
• Your account information must be accurate, current, and belong to you.
• You are responsible for protecting your password, device, and login credentials.
• You may not transfer, sell, or rent your account without permission.
• If we suspect a security risk, identity issue, fake account, or abuse, we may request verification, limit access, or suspend the account.

FORGE bir fitness, antrenman, beslenme, recovery ve wellness aracıdır. Tıbbi cihaz değildir; teşhis, tedavi, klinik takip, acil müdahale, ruh sağlığı krizi desteği veya doktor tavsiyesi sunmaz. Egzersiz, diyet, supplement veya recovery kararlarının riski sana aittir. Ağrı, bayılma, göğüs sıkışması, nefes darlığı, sakatlık, hastalık, yeme bozukluğu, hamilelik, ilaç kullanımı, kronik rahatsızlık veya klinik takip gerektiren bir durum varsa lisanslı sağlık profesyoneline danış.

FORGE is a fitness, training, nutrition, recovery, and wellness tool. It is not a medical device and does not provide diagnosis, treatment, clinical monitoring, emergency intervention, mental health crisis support, or physician advice. Exercise, diet, supplement, and recovery decisions are your responsibility. If you experience pain, fainting, chest tightness, shortness of breath, injury, illness, eating disorders, pregnancy, medication use, chronic conditions, or any situation requiring clinical monitoring, consult a licensed health professional.

• AI koç ve otomatik öneriler yalnızca bilgi, planlama ve performans desteği amacıyla sunulur.
• Öneriler verilerinin eksik, eski, yanlış veya bağlam dışı olmasından etkilenebilir ve hatalı olabilir.
• Uygulama hiçbir sonuç, kilo değişimi, güç artışı, sakatlıksız ilerleme veya sağlık sonucu garanti etmez.
• Uygulamayı steroid, performans artırıcı yasa dışı madde, tehlikeli kilo kesme, aşırı kalori kısıtlaması veya yasa dışı sağlık yönlendirmesi için kullanamazsın.
• Acil durumda uygulamayı bekleme; yerel acil yardım hattına veya sağlık profesyoneline başvur.

• AI coach and automated recommendations are provided only for informational, planning, and performance support.
• Recommendations may be affected by incomplete, outdated, inaccurate, or out-of-context data and may be wrong.
• The app does not guarantee any result, weight change, strength gain, injury-free progress, or health outcome.
• You may not use the app for steroids, illegal performance-enhancing substances, dangerous weight cutting, extreme calorie restriction, or illegal health guidance.
• In an emergency, do not wait for the app; contact local emergency services or a health professional.

5. FORGE Pro, abonelikler ve mağaza faturalandırması

5. FORGE Pro, subscriptions, and store billing

• FORGE Pro, App Store veya Google Play üzerinden sunulan otomatik yenilenen aboneliklerle sağlanabilir.
• Fiyat, para birimi, vergi, ücretsiz deneme, kampanya, faturalandırma dönemi ve yenileme şartları mağaza ekranında gösterilir ve ülkeye göre değişebilir.
• Abonelik, mevcut dönemin bitiminden önce iptal edilmezse mağaza kurallarına göre otomatik yenilenebilir.
• İptal, ödeme yöntemi yönetimi, aile paylaşımı uygunluğu ve geri ödeme talepleri App Store veya Google Play hesabın üzerinden yürür.
• FORGE kart bilgilerini saklamaz ve mağaza tarafından verilen geri ödeme kararlarını kontrol etmez.
• Satın almaları uygulama içinden geri yükleyebilirsin. Entitlement yönetimi için RevenueCat veya benzer doğrulama servisleri kullanılabilir.
• Yasadaki zorunlu tüketici hakların saklıdır.

• FORGE Pro may be provided through auto-renewing subscriptions sold via the App Store or Google Play.
• Price, currency, tax, free trial, promotion, billing period, and renewal terms are shown on the store screen and may vary by country.
• Unless cancelled before the current period ends, the subscription may auto-renew under store rules.
• Cancellation, payment method management, family sharing eligibility, and refund requests are handled through your App Store or Google Play account.
• FORGE does not store card details and does not control refund decisions made by the store.
• You can restore purchases inside the app. RevenueCat or similar verification services may be used for entitlement management.
• Mandatory consumer rights under law remain unaffected.

6. Kabul edilebilir kullanım

• Hizmeti hukuka uygun, kişisel ve makul kullanım sınırları içinde kullanmalısın.
• Paywall, abonelik, güvenlik, App Check, kimlik doğrulama veya API sınırlarını aşmaya çalışamazsın.
• Bot, scraper, otomatik hesap, tersine mühendislik, veri madenciliği veya yetkisiz erişim kullanamazsın.
• Virüs, zararlı kod, overload, spam, phishing, sahte yarışma veya dolandırıcılık amacıyla hizmeti kullanamazsın.
• Başkalarının hesabına, verisine, cihazına, fotoğrafına veya topluluk içeriğine izinsiz erişemezsin.
• Hizmeti rakip ürün eğitimi, toplu veri çıkarımı veya FORGE sistemlerini kopyalama amacıyla kullanamazsın.

• You must use the service lawfully, personally, and within reasonable usage limits.
• You may not bypass paywalls, subscriptions, security, App Check, authentication, or API limits.
• You may not use bots, scrapers, automated accounts, reverse engineering, data mining, or unauthorized access.
• You may not use the service for viruses, malicious code, overload, spam, phishing, fake contests, or fraud.
• You may not access another person's account, data, device, photo, or community content without permission.
• You may not use the service to train competing products, extract data at scale, or copy FORGE systems.

• Mesaj, fotoğraf, proof post, program, tarif, challenge, yorum, kulüp adı ve diğer içeriklerinden sen sorumlusun.
• İçerik paylaşmadan önce gerekli haklara, izinlere ve kişisel veri onaylarına sahip olmalısın.
• Taciz, tehdit, nefret söylemi, cinsel içerik, çocuk istismarı, doxxing, özel veri paylaşımı, spam, dolandırıcılık, yasa dışı madde satışı, telif ihlali ve tehlikeli sağlık yönlendirmesi yasaktır.
• Topluluk içerikleri kulüp üyelerine, davet edilen kullanıcılara veya seçtiğin görünürlük ayarına göre diğer kullanıcılara gösterilebilir.
• İçerikleri inceleyebilir, kaldırabilir, görünürlüğünü azaltabilir, raporları değerlendirebilir, kulüp erişimini sınırlayabilir veya hesabı askıya alabiliriz.
• Moderasyon her ihlali önceden tespit edeceğimiz anlamına gelmez; uygunsuz içerikleri destek akışından raporlamalısın.

• You are responsible for messages, photos, proof posts, programs, recipes, challenges, comments, club names, and other content you provide.
• Before sharing content, you must have the required rights, permissions, and personal data consents.
• Harassment, threats, hate speech, sexual content, child exploitation, doxxing, private data sharing, spam, fraud, illegal substance sales, copyright abuse, and dangerous health guidance are prohibited.
• Community content may be shown to club members, invited users, or other users according to the visibility setting you choose.
• We may review, remove, reduce visibility, evaluate reports, limit club access, or suspend accounts.
• Moderation does not mean we will detect every violation in advance; report inappropriate content through support flows.

8. Kullanıcı içeriği lisansı

İçeriğinin mülkiyeti sende kalır. Ancak hizmeti işletmek, saklamak, senkronlamak, göstermek, yedeklemek, teknik olarak dönüştürmek, güvenliği sağlamak, destek vermek ve moderasyon yapmak için bize dünya çapında, münhasır olmayan, telifsiz, devredilebilir, alt lisanslanabilir ve hizmetle sınırlı bir kullanım izni verirsin. İçeriği uygulamadan sildiğinde bu izin aktif hizmet yüzeyleri için sona erer; yedekler, güvenlik kayıtları ve yasal saklama gerekleri sınırlı süre devam edebilir.

You retain ownership of your content. However, to operate, store, sync, display, back up, technically transform, secure, support, and moderate the service, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable, service-limited license. When you delete content from the app, this license ends for active service surfaces; backups, safety records, and legal retention requirements may continue for a limited time.

9. Gizlilik ve sağlık verileri

Gizlilik Politikası bu şartların parçasıdır. HealthKit, Health Connect ve bağlı sağlık verileri yalnızca izin verdiğin veri tipleri ve beklenen fitness/recovery özellikleri için kullanılır. Sağlık verilerini reklam hedefleme, veri satışı, sigorta, kredi, istihdam veya benzer kararlar için kullanmayız.

The Privacy Policy is part of these terms. HealthKit, Health Connect, and connected health data are used only for the data types you authorize and for expected fitness/recovery features. We do not use health data for ad targeting, data sale, insurance, credit, employment, or similar decisions.

10. Üçüncü taraf hizmetler

10. Third-party services

FORGE; App Store, Google Play, Apple Health, Health Connect, Firebase, Google Cloud, RevenueCat, bağlı sağlık sağlayıcıları ve diğer üçüncü taraf servislerle çalışabilir. Bu servislerin kullanılabilirliği, veri doğruluğu, fiyatlandırması, kesintileri ve kendi şartları bizim kontrolümüzde değildir. Üçüncü taraf hesaplarını bağladığında, ilgili sağlayıcının şartları ve gizlilik politikaları da geçerli olabilir.

FORGE may work with App Store, Google Play, Apple Health, Health Connect, Firebase, Google Cloud, RevenueCat, connected health providers, and other third-party services. Their availability, data accuracy, pricing, outages, and terms are not controlled by us. When you connect third-party accounts, that provider's terms and privacy policies may also apply.

11. Fikri mülkiyet

FORGE adı, marka işaretleri, arayüzler, yazılım, tasarımlar, metinler, görsel sistem, algoritmalar, veritabanı yapıları ve hizmetin diğer unsurları FORGE veya lisans verenlerine aittir. Bu şartlar sana yalnızca kişisel, devredilemez, sınırlı ve iptal edilebilir bir kullanım hakkı verir. FORGE markasını, ekranlarını veya sistemlerini izinsiz kopyalayamaz, çoğaltamaz, dağıtamaz veya ticari olarak kullanamazsın.

The FORGE name, brand marks, interfaces, software, designs, text, visual system, algorithms, database structures, and other service elements belong to FORGE or its licensors. These terms grant you only a personal, non-transferable, limited, revocable right to use the service. You may not copy, reproduce, distribute, or commercially use FORGE branding, screens, or systems without permission.

12. Hizmet değişiklikleri ve erişim

12. Service changes and access

Özellikleri ekleyebilir, değiştirebilir, kaldırabilir, fiyatlandırmayı güncelleyebilir, bakım yapabilir veya belirli entegrasyonları sonlandırabiliriz. Uygulama kesintisiz, hatasız veya her cihaz, ülke, veri kaynağı ya da işletim sistemi sürümüyle sürekli uyumlu çalışacak diye garanti verilmez.

We may add, change, remove features, update pricing, perform maintenance, or discontinue certain integrations. The app is not guaranteed to be uninterrupted, error-free, or continuously compatible with every device, country, data source, or operating system version.

13. Askıya alma ve fesih

13. Suspension and termination

Bu şartları ihlal edersen, hukuki risk doğurursan, güvenlik tehdidi oluşturursan, ödeme/abonelik sahteciliği yaparsan, topluluk güvenliğini bozarsan veya sistemi kötüye kullanırsan hesabını askıya alabilir, içeriklerini kaldırabilir ya da erişimini sonlandırabiliriz. Hesabını uygulama içinden veya destek üzerinden kapatma talebi gönderebilirsin; abonelik iptali ayrıca mağaza hesabın üzerinden yapılmalıdır.

If you violate these terms, create legal risk, pose a security threat, commit payment/subscription fraud, harm community safety, or misuse the system, we may suspend your account, remove content, or terminate access. You may request account closure inside the app or through support; subscription cancellation must also be completed through your store account.

Yürürlükteki hukukun izin verdiği en geniş ölçüde hizmet "olduğu gibi" ve "mevcut olduğu şekilde" sunulur. Belirli bir fitness sonucu, kas kazanımı, kilo kaybı, recovery skoru, sağlık sonucu, veri doğruluğu, uyumluluk, kesintisizlik veya hatasız çalışma garanti edilmez. Bazı ülkelerde tüketici hakları nedeniyle belirli garantilerin hariç tutulması mümkün olmayabilir; bu durumda bu sınırlamalar yalnızca izin verilen ölçüde uygulanır.

To the maximum extent permitted by law, the service is provided "as is" and "as available." We do not guarantee any specific fitness outcome, muscle gain, weight loss, recovery score, health result, data accuracy, compatibility, uninterrupted availability, or error-free operation. Some jurisdictions may not allow exclusion of certain warranties because of consumer rights; in that case these limits apply only to the extent permitted.

Yürürlükteki hukukun izin verdiği ölçüde FORGE; dolaylı, arızi, özel, cezai veya sonuçsal zararlardan, veri kaybından, kar kaybından, itibar kaybından, antrenman/sağlık kararlarından, üçüncü taraf servis kesintilerinden veya kullanıcı içeriğinden sorumlu değildir. Hiçbir hüküm, kasıt, ağır ihmal, ölüm, bedensel zarar veya zorunlu tüketici hakları için hukuken sınırlandırılamayan sorumluluğu dışlamaz.

To the extent permitted by law, FORGE is not liable for indirect, incidental, special, punitive, or consequential damages; data loss; lost profits; reputation harm; training/health decisions; third-party service outages; or user content. Nothing excludes liability that cannot legally be limited, including intentional misconduct, gross negligence, death, personal injury, or mandatory consumer rights.

16. Tazmin ve zarar karşılama

Hukukun izin verdiği ölçüde; bu şartları ihlal etmen, izinsiz içerik paylaşman, üçüncü taraf haklarını ihlal etmen, topluluk kurallarını bozman veya hizmeti kötüye kullanman nedeniyle FORGE'a yönelen makul talep, zarar, masraf ve hukuki giderlerden sorumlu olabilirsin. Tüketici hukukundan doğan zorunlu hakların saklıdır.

To the extent permitted by law, you may be responsible for reasonable claims, damages, costs, and legal expenses against FORGE caused by your violation of these terms, unauthorized content, infringement of third-party rights, community rule violations, or misuse of the service. Mandatory consumer rights remain unaffected.

17. Uygulanacak hukuk ve uyuşmazlıklar

17. Governing law and disputes

Zorunlu tüketici hukuku hükümleri saklı kalmak kaydıyla, bu şartlar Türkiye hukuku çerçevesinde yorumlanır. Uyuşmazlık çıkarsa önce destek üzerinden iyi niyetli çözüm aramanı rica ederiz. Bulunduğun ülkedeki zorunlu tüketici koruma, veri koruma ve mağaza kuralları bu hükümlerin önüne geçebilir.

Subject to mandatory consumer law, these terms are interpreted under the laws of Türkiye. If a dispute arises, we ask that you first try to resolve it in good faith through support. Mandatory consumer protection, data protection, and store rules in your country may override these provisions.

Ürün, abonelikler, yasal gereklilikler veya mağaza kuralları değiştikçe bu şartları güncelleyebiliriz. Önemli değişiklikleri uygulama içi bildirim, e-posta, web sitesi duyurusu veya mağaza açıklaması gibi uygun kanallarla duyurabiliriz. Güncellenmiş şartlar yayınlandığı tarihte yürürlüğe girer; kullanmaya devam etmen yeni şartları kabul ettiğin anlamına gelebilir.

We may update these terms when the product, subscriptions, legal requirements, or store rules change. We may announce material changes through appropriate channels such as in-app notice, email, website notice, or store description. Updated terms take effect when posted; continued use may mean you accept the new terms.
